The Court of Appeals of Helsinki (Helsingin hovioikeus) has upheld
the decision of the local court of Helsinki, in which Johan "Julf"
Helsingius was ordered to reveal the user id of the person who used
the anon.penet.fi server to repost parts of Scamizdat, a collection
of secret Scientology scriptures.

In its decision dated 4th of June 1997, the Court of Appeals orders
Helsingius to reveal the names in 30 days after the decision becomes
final. If he doesn't try to appeal the decision it will mean that he
has to reveal the user id within three months. He might appeal the
decision to the Supreme Court within 60 days, in which case the
whole thing will take longer, regardless of whether the Supreme
Court chooses to consider the case or not.

The Supreme Court might try this case. It's a very unusual one.
There are constitutional concerns as well as many procedural
questions involved. There are some interesting observations in the
ruling of the Court of Appeals, which can't be described right now.
Suffice to say that it's a very conservative ruling and it's not
impossible it could be overturned by the Supreme Court if they
consider the case.


Since many have asked me how all this started and what material was
involved, here are some details from the court documents.

The following ID's were used to send material through anon.penet.fi:

        an498608@anon.penet.fi
        an545430@anon.penet.fi

The whole case is about the identity of the person(s) who used these
anonymous ID's. Of course it's probable that a forged ID or a chain
of remailers has been used, and the whole lawsuit is a waste of time
and money. (So far Helsingius has spent something like 170,000 FMK,
at least 30,000 USD, very unusual for a witness).

The following Scientology organizations were involved in asking the
court to force Julf to reveal the names:

        Church of Spiritual Technology
        Religious Technology Center
        New Era Publications International APS

The lawyer representing these Scientology organizations was Mr.
Jussi Savonen, from the law firm of Peltonen, Örndahl, Ruokonen &
Itäinen, one of the largest firms in Finland.

The material was a repost of Scamizdat #11, in several parts. The
original repost was done on 15.2.1996, and partly repeated
12.3.1996.

The titles below were listed by Mr. Savonen as copyright violations.
In addition, there were also some "secret" scriptures posted, not
mentioned here. "Jaksossa 4/18" etc is Finnish and means "In part
4/18" etc. I don't know what this means, perhaps the Scamizdat
repost was sent in several parts. In the newspapers it has been
mentioned that "hundreds of pages of Scientology scriptures" were
sent.
